சேலம் – ஓமலூர் பகுதியைச் சார்ந்த தலித் இளைஞர் கோகுல்ராஜ் படுகொலை செய்யப்பட்ட வழக்கில் சிறப்பு நீதிமன்றம் குற்றவாளிகள் பத்து பேருக்கு ஆயுள் தண்டனை அளித்தது. அத்தீர்ப்பை எதிர்த்துக் குற்றவாளிகள் தரப்பில் செய்யப்பட்ட மேல்முறையீட்டு வழக்கில் இன்று உயர்நீதிமன்றம் அத்தண்டனையை உறுதிசெய்து தீர்ப்பு வழங்கியுள்ளது. முதன்மைக் குற்றவாளி உட்பட
8 பேரின் தண்டனையை உறுதி செய்திருக்கிறது. 2 பேரின் தண்டனையை 5 ஆண்டுகள் கடுங்காவல் தண்டனை எனக் குறைத்திருக்கிறது. இதற்காக வாதாடிய வழக்கறிஞர்கள் பா.பா.மோகன், லஜபதி ராய் ஆகியோருக்கும்; அரசுத் தரப்பு வழக்கறிஞருக்கும் எமது பாராட்டுகளைத் தெரிவித்துக்கொள்கிறோம்.

”முதன்மைக் குற்றவாளி யுவராஜ் ஊடகங்களில் தவறான தகவல்களைக் கூறி திசை திருப்ப முயற்சித்தாலும் சிறப்பு நீதிமன்றம் தெளிவாக விசாரித்துத் தீர்ப்பளித்திருக்கிறது” என உயர்நீதிமன்ற நீதிபதிகள் பாராட்டியுள்ளனர்.

“ எதிரிகளுக்கும் இறந்துபோன கோகுல்ராஜ் மற்றும் சுவாதிக்கும் இடையே சம்பவ காலத்திற்கு முன்பு அறிமுகமே கிடையாது. கோகுல்ராஜை கொலை செய்யக்கூடிய அளவுக்கு அவர்களுக்கு இடையே ஆழமான விரோதமும் இல்லை. ஒரு சாதி அமைப்பின் தவறான கொள்கை மற்றும் சித்தாந்தத்தின் அடிப்படையில்” இந்தக் கொலை செய்யப்பட்டு இருக்கிறது” எனத் தனது தீர்ப்பில் கூறியிருந்த சிறப்பு நீதிமன்றம், ‘இந்தக் கொலைக் குற்றத்துக்கு முன் விரோதமோ, பகைமையோ காரணம் அல்ல; இந்த எதிரிகள் யாவரும் ஒரு சாதி அமைப்பில் உறுப்பினர்களாக இருந்ததனால்தான் அவர்கள் இந்த கொலையைச் செய்து இருக்கிறார்கள்’ என்றும் தெளிவாகக் குறிப்பிட்டிருந்தது. சிறப்பு நீதிமன்றத்தின் இந்தக் கருத்தை உயர்நீதிமன்றம் உறுதிசெய்துள்ளது.

இந்த சூழலில் ஆணவக்கொலைத் தடுப்புச் சட்டம் இயற்ற வேண்டிய தேவையை அரசின் கவனத்திற்குக் கொண்டுவருவதை விடுதலைச் சிறுத்தைகள் கட்சியின் கடமையாகக் கருதுகிறோம். அதாவது, ஆணவக்கொலை குற்றங்களைத் தடுப்பது தொடர்பாக 2018 ஆம் ஆண்டு மார்ச் மாதத்தில் உச்சநீதிமன்ற அமர்வு முக்கியத்துவம் வாய்ந்த தீர்ப்பு ஒன்றை வழங்கியுள்ளது.”

அத்துடன், ஆணவக் கொலைகளைத் தடுப்பதற்காகவும், அதனால் பாதிக்கப்படுகிறவர்களுக்கு நிவாரணம் அளிப்பதற்காகவும் , அந்தக் குற்றத்தில் ஈடுபடுகிறவர்களைத் தண்டிப்பதற்காகவும் சிறப்பு சட்டம் ஒன்றை இயற்றவேண்டும்” எனவும் அந்தத் தீர்ப்பில் உச்சநீதிமன்றம் பரிந்துரை செய்திருக்கிறது. அப்படியான சட்டம் ஒன்றைத் தமிழ்நாடு அரசு இயற்ற முன்வரவேண்டும் எனக் கேட்டுக் கொள்கிறோம்.

அந்த சட்டம் இயற்றப்படும் வரை இந்திய ஒன்றிய, மாநில அரசுகள் கடைபிடிக்கவேண்டிய வழிகாட்டு நெறிமுறைகளையும் உச்சநீதிமன்றம் வழங்கியிருக்கிறது. தடுப்பு நடவடிக்கைகள், நிவாரண நடவடிக்கைகள், தண்டனை நடவடிக்கைகள் என மூன்று தலைப்புகளில் வழிகாட்டு நெறிமுறைகளை உச்சநீதிமன்றம் அளித்திருக்கிறது. அவற்றைச் செயல்படுத்துவதற்குத் தமிழ்நாடு அரசு முன்வர வேண்டும்.
